Welcome to Choco Sync. These Terms & Conditions govern your use of our website and the purchase of our products. By accessing or using our website, you agree to be bound by these terms. If you do not agree to these terms, please do not use our website or purchase our products.
1. About Us
Choco Sync (ABN 58 359 067 847) is an artisanal chocolate brand offering handcrafted chocolate products made with care and premium ingredients. Our online store is hosted on the Shopify platform. Checkout, payment processing, and certain site functionality are provided by Shopify Inc. and are subject to Shopify’s own Terms of Service.
2. Use of Website
You agree to use this website only for lawful purposes and in a way that does not infringe the rights of others or restrict or inhibit anyone else’s use of the website.
You must not:
• Misuse the website or attempt to gain unauthorised access to any part of the website, its server, or any connected database.
• Use the website to transmit harmful, malicious, or offensive content, or content that infringes intellectual property rights.
• Use the website for any fraudulent or unlawful purpose.
• Introduce viruses, trojans, worms, or other technologically harmful material.
3. Products & Orders
• All products are subject to availability. We will notify you as soon as possible if a product you have ordered is unavailable.
• We reserve the right to refuse or cancel any order where products are unavailable, payment cannot be verified, or we reasonably suspect fraudulent activity. If we cancel your order, you will receive a full refund.
• Product images are for illustration purposes only. Actual products may vary slightly in colour, shape, or decoration due to their handmade nature.
• An order confirmation email does not constitute acceptance of your order. A binding contract is formed only when your order has been dispatched.
4. Age Restriction
Some of our products contain alcohol (liqueur-infused chocolates). By purchasing these products, you confirm that you are 18 years of age or older. We reserve the right to refuse the sale of alcohol-containing products where we reasonably believe the purchaser is under 18.
5. Pricing
• All prices are listed in Australian Dollars (AUD).
• Prices may change at any time, but changes will not affect orders that have already been confirmed.
• We make every effort to ensure pricing accuracy. In the unlikely event that a product is listed at an incorrect price, we will contact you before processing the order and give you the option to proceed at the correct price or cancel for a full refund.
6. Payments
We accept secure payments through approved payment providers via the Shopify platform. All payment information is encrypted under PCI-DSS standards. By placing an order, you confirm that the payment details you provide are valid and that you are authorised to use the payment method.
7. Shipping & Delivery
• Delivery times provided at checkout are estimates and may vary depending on your location and courier services.
• We use insulated or temperature-appropriate packaging where necessary. However, during warmer months we recommend selecting express shipping to minimise transit time for perishable products.
• While some delivery delays are beyond our control, if your order fails to arrive within a reasonable timeframe or is lost in transit, please contact us and we will work to resolve the issue.
• Risk of loss and damage passes to you upon delivery. We recommend ensuring someone is available to receive the order promptly.
Cancellations
• Orders may be cancelled within 12 hours of placing the order, provided production has not yet begun.
• Once production has begun or the order has been dispatched, cancellations are not possible due to the perishable nature of our products.

8. Returns & Refunds
Due to the perishable nature of our products, change-of-mind returns are not available. This does not affect your rights under the Australian Consumer Law where products are faulty, not as described, or fail to meet consumer guarantees.
You may be eligible for a refund or replacement if:
• Your order arrives damaged or in a materially compromised condition.
• You receive the wrong product.
• The product does not match its description.
To make a claim, contact us within 48 hours of delivery with your order number and clear photographic evidence. Claims made after 48 hours will be assessed on a case-by-case basis but may not be eligible.

9. Allergies & Ingredients
Our products may contain allergens including but not limited to nuts, dairy, soy, and gluten. All chocolates contain soya lecithin. We prepare all our products in one facility, which means cross-contamination may occur.
Important: We do not recommend our products for anyone with nut, dairy, soy, gluten, or any food-related allergies due to the risk of cross-contamination. Customers are responsible for checking ingredient and allergen information on product packaging before consumption.
10. Intellectual Property
All content on this website, including but not limited to images, text, branding, logos, and design, is the property of Choco Sync or its licensors and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, or use any content without our prior written permission.
11. Limitation of Liability
Nothing in these terms excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded by law.
Subject to the above, and to the maximum extent permitted by law:
• Choco Sync shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our website or products.
• Our total liability to you for any claim is limited to the total amount you paid for the relevant order.
12. Force Majeure
Choco Sync is not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, supply chain disruptions, government actions, postal or courier disruptions, or extreme weather events.
13. Privacy
Your use of this website is also governed by our Privacy Policy, which is available as a separate document on our website. Please review it carefully.
14. Changes to Terms
We reserve the right to update these Terms & Conditions at any time. Updated terms will be posted on this page and will apply to orders placed after the date of posting. We encourage you to review these terms periodically.
15. Governing Law
These terms are governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising under these terms are subject to the exclusive jurisdiction of the courts of Victoria.
16. Dispute Resolution
If you have a dispute with us, we encourage you to contact us first so we can attempt to resolve it informally. If we cannot resolve the dispute, either party may pursue remedies available under Australian law, including through Consumer Affairs Victoria or the Australian Competition and Consumer Commission (ACCC).
